Email Coaching Service Terms

The terms and conditions below apply to all email coaching responses, provided by David Bonham-Carter (“David”) to any individual or organisation ("the client") and constitute the contract for the service to be provided by David for the client. In return for the fees payable by the client (or by a third party on their behalf), David agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay a fee for the service as specified below and on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client.

Eligibility

To use this email coaching service the client must be aged 18 years or over.

Service to be provided

In return for payment of the email coaching fee specified on this website - or such other fee as is agreed in writing - David agrees to provide a response by email to the client's email query or request. David is not obliged to provide any response until he has received payment of the fee.

If for any reason David is unable to give a response to the client's query or feels that it would be inappropriate for him to give a response then he will give the client a full refund of any relevant fee that has been paid. In such circumstances once the fee has been refunded David will be under no obligation to provide a response.

In most cases David will provide an email response within 3 working days of the request. Where this is not possible due to holiday or any other reason, the client may claim a full refund of any payment made, provided that such refund is requested within 28 days of the fee having been paid.

Confidentiality

Personal information or business information supplied by the client will be treated as confidential. It will not be disclosed to a third party without the client's prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.

Responsibilities

Through the email coachiang service, David will seek to help the client to manage or deal effectively with the issues that are of concern to them. However, the client has sole responsibility for taking important decisions in their life or business.  David has no liability for any loss incurred by any client, whether financial or otherwise, following the exchange of emails between the client and David, or for any perceived failure by the client, whether justified or otherwise, to make progress on the issues that are of concern to them.

Variation of Terms and Conditions

David may change any of these terms or conditions including the fee by giving the client one week’s notice in writing by letter or e-mail of the change(s). If following receipt of such notification of change, the client no longer wishes to proceed with further email coaching, they may withdraw from the service immediately by giving notice in writing by email or letter and they will then be entitled to a full refund of any fees paid in advance for email coaching yet provided. Such notice will be effective on receipt by David.

Governing Law

This contract is governed by the law of England whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.
